The Marriage Cruise for Christian Couples - Participant Agreement
Agreement Between: Therapevo Counseling Inc., a Saskatchewan corporation, (hereinafter "Organizer") and the individual(s) completing the booking (collectively, "Participants").
Subject: The Marriage Cruise for Christian Couples Event: A group marriage retreat (defined herein as "The Marriage Retreat Experience") hosted by Organizer's principals, Caleb and Verlynda Simonyi-Gindele, conducted during the cruise sailing booked by the Participant.
1. Scope of Services
Organizer agrees to provide the following services (the "Retreat Experience"):
- All scheduled group marriage enrichment seminars led by the Organizers.
- Retreat-related materials, specifically including Retreat Workbooks and a meeting schedule.
- A private Welcome Reception for Retreat Participants.
- An explicit clarification: The services provided during the Retreat Experience are for educational and enrichment purposes only and are not, and shall not be construed as, marriage counseling or psychotherapy.
Participants understand that any separate therapeutic or counseling services (including those offered via Zoom by Therapevo Counseling Inc.) are not included in this Agreement and must be contracted for separately.
2. Fees and Payments
- 2.1. The Retreat Fee: Participants agree to pay Organizer a "Retreat Fee" for the services listed in Section 1. The specific amount of the Retreat Fee shall be the amount listed on the Participant's invoice or booking confirmation.
- 2.2. Payment of Retreat Fee: The Retreat Fee is due and payable on or before the cruise line's final payment date, and will be billed by the Organizer or its designated agent.
- 2.3. Mandatory Group Booking for Cruise: Participants acknowledge that to be eligible to attend the Retreat Experience, they must book their cruise stateroom through the Organizer's designated group booking contact (e.g., a specific travel agent or cruise line group coordinator) provided by the Organizer.
- 2.4. Condition of Eligibility: Participants are eligible to register for the Retreat Experience only after they have successfully booked and confirmed their cruise stateroom through the Organizer's designated group booking contact. Any participant who books their cruise independently is not eligible to register or participate in the Retreat Experience.
- 2.5. Responsibility for Other Costs: Participants are responsible for all other travel and personal costs not explicitly included in the advertised bundled price. This includes, but is not limited to:
- (a) Airfare;
- (b) Travel insurance;
- (c) Cruise gratuities (which are not included in the advertised price);
- (d) All personal onboard expenses (such as spa services, alcoholic beverages, specialty dining, or shore excursions). Participants may book their airfare and travel insurance through the Organizer's designated contact or independently, at their discretion.
- 2.6. Advertised Price and Billing: Participants understand that while Organizer may advertise a single, bundled price for marketing convenience, this price is comprised of two separate components:
- (a) the Retreat Fee (and applicable taxes) paid to the Organizer; and
- (b) the Cruise Fare paid to the cruise line or its designated agent. The advertised bundled price reflects the inclusion of the cruise line's taxes, fees, and port expenses. The advertised price does not include cruise gratuities, which remain the Participant's separate responsibility as noted in Section 2.5.
- 2.7. Currency: Participants acknowledge that all prices quoted, invoiced, and processed for both the Retreat Fee and the Cruise Fare are in U.S. Dollars (USD).
3. Cruise Line as Third-Party
Participants understand and agree that the cruise line (e.g., Celebrity, Royal Caribbean, etc.) is an independent third-party contractor and is an entity separate from Organizer.
- Organizer is not an agent of, and has no control over, the cruise line or any of its employees or vendors.
- Participants acknowledge they are bound by the Cruise Line's Ticket Contract (the legally binding agreement they enter into with the cruise line upon booking).
- Organizer is not responsible for the cruise line's performance, including but not limited to: changes in itinerary, delays, quality of food or service, onboard safety, mechanical issues, or the provision of medical facilities.
- Any claim or dispute Participants have regarding the cruise portion of their trip (including stateroom, food, excursions, safety, etc.) must be directed solely to the cruise line.
4. Cancellation and Refund Policy
This section governs the Retreat Fee only. All cruise-related cancellations and refunds are subject to the cruise line's policies.
- 4.1. Cancellation by Participant: If Participants must cancel their attendance at the Retreat Experience for any reason, they must notify the Organizer in writing (e.g., via email) at any time before the cruise departure date. Upon receiving notice, Participants may choose one (1) of the following options:
- (a) Credit: Apply 100% of the Retreat Fee paid as a credit for a future retreat hosted by Organizer. This credit must be used within one (1) calendar year of the original cruise departure date.
- (b) Refund: Receive a refund of the Retreat Fee paid, less a ten percent (10%) administrative processing fee of the total Retreat Fee.
- 4.2. Failure to Notify (No-Show): Failure to provide written notice of cancellation before the cruise departure date will be considered a "no-show" and will result in a full forfeiture of the entire Retreat Fee.
- 4.3. Cancellation of Cruise by Cruise Line: If the cruise line cancels the entire sailing due to unforeseen circumstances (such as a hurricane, pandemic, mechanical failure, or other force majeure event), Participants will be entitled to choose one (1) of the following remedies from the Organizer:
- (a) Refund: A full 100% refund of the Retreat Fee paid, processed within [30] days of the cancellation.
- (b) Credit: A 100% credit of the Retreat Fee paid to be applied to a future retreat hosted by Organizer. This credit must be used within twenty-four (24) months of the original cruise departure date.
- 4.4. Total Cancellation by Organizer: If the Organizer (Caleb and/or Verlynda Simonyi-Gindele) fails to board the ship or becomes unable to lead the entire Retreat Experience due to illness, personal emergency, or other unforeseen event, Participants will be refunded 100% of the Retreat Fee paid. The Organizer's liability in this event is limited strictly to the refund of this fee.
- 4.5. Partial Delivery by Organizer (Missed Sessions): If the Retreat Experience commences but the Organizer becomes temporarily unable to lead one or more of the scheduled marriage enrichment seminars due to illness or personal emergency, Organizer's sole obligation to Participants will be to provide "make-up" sessions covering the missed content. These make-up sessions will be conducted via a group Zoom video call at a mutually agreeable time after the cruise is complete. This provision shall serve as the full and complete remedy for any such missed sessions, and Participants shall not be entitled to a partial refund.
- 4.6. No Refunds After Commencement: While Organizer will make a reasonable effort to address any participant concerns expressed during the Retreat Experience, Participants agree that once the cruise departure date has passed and the Retreat Experience has commenced, no refunds (full or partial) will be issued for the Retreat Fee for any reason. This includes, but is not limited to, a Participant's non-attendance at sessions, dissatisfaction with the seminar content or discussions, or a Participant's subjective personal or emotional response to the material or other participants.
5. Disclaimers and Limitation of Liability
- 5.1. Disclaimer of Professional Services: Participants expressly acknowledge and agree that the Retreat Experience services listed in Section 1 are not psychotherapy, marriage counseling, or any form of clinical mental health treatment. The Organizers (Caleb and Verlynda Simonyi-Gindele) are acting in the capacity of retreat hosts and educators, not as the Participants' clinical counselors or therapists. The Retreat Experience is for educational and marriage enrichment purposes only.
- 5.2. Personal Responsibility and Choice: Participants acknowledge that their participation in the Retreat Experience is voluntary. They are solely responsible for all decisions and choices they make regarding their relationship, personal lives, and actions, both during and after the Retreat Experience. Participants agree that any outcomes, whether personal or marital, resulting from their participation in the Retreat Experience are their own responsibility.
- 5.3. No Responsibility for Third-Party Conduct: While Organizer will use reasonable efforts to foster a safe and respectful group environment, Participants acknowledge that the Retreat Experience involves group interaction. Organizer is not responsible for the statements, opinions, or conduct of other retreat participants. Organizer does not endorse, and shall not be held liable for, any comments or actions made by other participants.
- 5.4. General Release of Liability: Participants agree to release, waive, and hold harmless the Organizer (Therapevo Counseling Inc.), its officers, and its principals (Caleb and Verlynda Simonyi-Gindele) from any and all claims, liabilities, damages, or losses arising from or related to:
- (a) Any injury, loss, or damage sustained while on the cruise, in any port of call, or during any shore excursion.
- (b) Any dispute with the cruise line or other third-party vendors.
- (c) Any personal or marital outcomes resulting from participation in the Retreat Experience.
- 5.5. Limitation of liability: In the event of any claim, judgment, or finding of liability against the Organizer, Participants agree that the Organizer's maximum total liability shall be strictly limited to the total Retreat Fee paidby the Participants to the Organizer.
6. Media, Recording, and Privacy
- 6.1. General Media Release: Participants grant to Organizer (Therapevo Counseling Inc.) the right to use, reproduce, and publish any photographs and video recordings (B-roll) made of them during the Retreat Experience (e.g., group photos, general session atmosphere). This media may be used for marketing, promotional, and commercial purposes (e.g., website, social media) without compensation.
- 6.2. Recording Notifications: Organizer agrees to verbally notify all participants before any group B-roll video recording begins.
- 6.3. Audio Recording Limitations: To protect participant privacy, no audio of any participant's personal sharing, group discussions, or Q&A will be recorded or distributed. Organizer reserves the right to make audio recordings only of the Organizers (Caleb and Verlynda Simonyi-Gindele) as they are presenting.
- 6.4. Testimonials: If a Participant provides a written or verbal testimonial, they grant Organizer the right to use and publish it for marketing and promotional purposes.
7. Code of Conduct
Organizer is dedicated to providing a safe, respectful, and positive environment for all Participants. Participants agree to conduct themselves in a manner that is respectful of other couples and the Organizers.
Organizer reserves the right to first issue a verbal warning to any Participant if their behavior is deemed disruptive, harassing, intoxicated, or otherwise detrimental to the group environment. If the behavior continues after such a warning, Organizer reserves the right, at its sole discretion, to remove the Participant from any or all remaining Retreat Experience sessions. If a Participant is removed for such behavior, it will be treated as a "no-show" for those sessions, and no refund (full or partial) will be issued.
8. Acceptance of Terms
By completing the registration process and paying the Retreat Fee, Participants acknowledge that they have read, understood, and agree to be bound by all terms and conditions set forth in this Participant Agreement.
